These Terms and Conditions apply to all website design, hosting, and maintenance services provided by JR Digital (“Designer”) to the client (“Client”). By engaging our services, the Client agrees to the following terms:

1. Payment Terms

  • Instalments: The Client may choose to pay in instalments. A 40% deposit is required followed by 3 equal monthly instalments which are subject to a 10% surcharge.
  • Payment in Full: If the Client pays in full upfront, they must adhere to the agreed production schedule. Failure to meet deadlines will result in a £25 weekly fee for each week the Client falls behind.
  • Invoices are payable according to the agreed schedule. Late payments may delay project completion.

1.1 Ad Hoc and Urgent Requests

While we are always happy to assist with last-minute changes or urgent work, these ad hoc requests can interrupt scheduled client projects. To manage workloads fairly, a minimum priority fee of £40 will apply to any same-day or next-day requests. This ensures that urgent work can still be accommodated without impacting other clients’ timelines.

2. Project Timeline & Responsibilities

  • The Designer will deliver the project according to the agreed timeline, provided the Client supplies content, feedback, and approvals on time.
  • Failure by the Client to meet deadlines may result in additional charges of £25 per week.

3. Content Submission

All content must be submitted in the following formats:

  • Images: WeTransfer or Dropbox.
  • Text: WeTransfer, Dropbox, or Word Document.
  • Not Accepted: Content submitted via WhatsApp or text message will not be used.

4. Modes of Contact

  • General Enquiries: Via email.
  • Technical Support: Via the online Tech Support Form available on our website.
  • Office Hours: Monday to Thursday, 8am – 5.30pm, Friday 8am – 3pm. Weekend support available on request.
  • After-Hours Support: Charged at a minimum of £40.
  • WhatsApp & Text Messages: May not be responded to.

5. Hosting & Maintenance

  • Once a website is completed and launched, ongoing hosting and maintenance fees will apply as per the Hosting & Maintenance Agreement.
  • Clients retain the right to move their website to another hosting provider at any time, provided all outstanding balances are paid.

6. Hosting Termination

  • Client-Initiated: Clients may terminate hosting by giving 30 days’ written notice. No refunds are given for unused hosting. Migration assistance can be provided at an additional cost.
  • Designer-Initiated: JR Digital may terminate hosting with 7 days’ notice if payments are missed, or if the website contains illegal, offensive, or harmful content.
  • Data Responsibility: Clients are responsible for securing their own website backups before termination. Backup retrieval after termination may incur an administrative fee.

7. Ownership & Intellectual Property

  • Full ownership of the website design is transferred to the Client once final payment has been received.
  • JR Digital retains rights to showcase the project in their portfolio.
  • Third-party components (e.g., plugins, stock images) are subject to their respective licences.

8. Refund Policy

  • Refunds are only available for work not yet completed. Completed milestones are non-refundable.
  • If the Client terminates early, they must pay for completed work plus a 20% cancellation fee of the remaining balance.
  • Refund requests must be submitted in writing within 14 calendar days of payment.

9. Third-Party Plugins & Modifications

  • JR Digital is not responsible for malfunctions, security issues, or errors caused by third-party plugins or code added without our knowledge or permission.
  • If the Client installs any third-party plugins or makes modifications to the website of their own accord, JR Digital is not liable for resulting errors or downtime.
  • Any troubleshooting or repairs required due to such changes will be charged at our standard hourly rate.

10. Break and Fix Support

Break and Fix support applies to issues, errors, or damage caused by actions taken by the Client or third parties acting on the Client’s behalf.

This includes (but is not limited to):

  • Editing content, layouts, or settings incorrectly
  • Installing, updating, or deleting plugins or themes
  • Uploading oversized or unoptimised files
  • Modifying code or site structure
  • Actions that result in broken layouts, errors, performance issues, or loss of functionality

Break and Fix work is not included within standard website design, hosting, or maintenance agreements.

All Break and Fix support is chargeable at a minimum fee of £60, which covers up to one hour of investigation and repair. Any work exceeding this time will be charged at the Designer’s standard hourly rate.

The Designer will assess the issue and advise on the estimated time and cost before proceeding where possible. Payment is required prior to work commencing unless otherwise agreed in writing.

JR Digital is not responsible for preventing or rectifying issues caused by Client actions unless Break and Fix support is explicitly requested and paid for.

11. Confidentiality

Both parties agree to maintain confidentiality of all project-related information, except where disclosure is required by law or agreed in writing.

12. Liability

JR Digital is not liable for:

  • Losses caused by Client delays.
  • Issues with third-party hosting providers or plugins.
  • Errors caused by Client-installed plugins or unauthorised modifications.

13. Governing Law

These Terms and Conditions are governed by the laws of [United Kingdom].
